House Rules & Policy

• MINORS: Minors under the age of 18 must be accompanied by an adult and may not be left unattended.
• MINIMUM AGE FOR BOOKING: All guests must be 21 years or older to confirm guest room accommodations at Arka Motel. A valid photo ID must be presented at the time of check in for age verification.
• CHECK-IN/CHECK-OUT: Check-in time is from 3:00 PM, and check-out time is by 11:00 AM.
• LATE CHECKOUT: Late checkout is subject to availability and there will be a $25 charge. If approval is not granted, late checkout may result in an additional night charge.
• PRICES AND TAXES: As mandated by the government of Arkansas, you will see a 9.5% total tax included in your bill. This total tax comprises a 6.5% State of Arkansas sales tax, a 1% Benton County tax, and a 2% State of Arkansas tourism tax. In addition, there is a $25 cleaning fee per reservation.
• ROOM CLEANING: If you need fresh towels or linens, please contact the front desk or email us at hello@arkamotel.com.
• CONDUCT:  Guests must conduct themselves in a respectful manner and not cause any disturbance to other guests. Excessive noise or disruptive behavior may result in eviction from Arka Motel without refund. Arka Motel reserves the right to refuse service or terminate a stay if guests behave inappropriately.
• SMOKING: Arka is a smoke-free property. Smoking in your room will result in a $500 charge plus any damage that may occur. 
• OUTSIDE VENDORS: For security and hygiene purposes, all outside vendors (e.g., massage therapists, tour operators, chefs, hair/makeup artists, photographers) must be approved by Arka Motel prior to providing services on the property. Guests are welcome to utilize any vendors of their choice at the vendors' own establishments.
• DAMAGES AND LOSSES: Guests are responsible for any damage or loss caused to Arka Motel's property during their stay. This includes, but is not limited to, damage to rooms, furnishings, fixtures, and equipment. Guests will be charged the full cost of repair or replacement for any damages or losses incurred. Additionally, Arka Motel reserves the right to charge an additional cleaning fee if the room is left in an excessively dirty or unkept condition.
• ACCIDENTAL DAMAGES: If a guest accidentally damages any property, they are required to inform Arka Motel staff immediately. Prompt reporting may help mitigate additional costs.
• DELIBERATE DAMAGES: Any deliberate damage to Arka Motel's property will be reported to law enforcement, and the guest responsible will be liable for all associated costs, including legal fees.
• LOSS OF REVENUE: If the damage caused by a guest results in a room being unavailable for subsequent guests, the responsible guest will be charged for the loss of revenue for the duration the room remains out of service.
• PERSONAL BELONGINGS: Arka Motel is not liable for any loss, damage, or theft of personal belongings. Guests are advised to take care of their valuables.
• POOL SAFETY AND WAIVER OF LIABILITY: 
• No Lifeguard on Duty: Guests are hereby informed that no lifeguard is on duty at the Arka Motel’s swimming pool. All guests swim at their own risk. Children under the age of 16 must be accompanied by an adult at all times while in the pool area.
• Pool Rules: For the safety and enjoyment of all guests, the following rules must be strictly observed: No running, diving, or horseplay in or around the pool area. No glass containers or alcoholic beverages are allowed in the pool area. Proper swimwear must be worn at all times. Guests must shower before entering the pool. Guests with health conditions should consult a doctor before swimming or heat exposure. Pets are not permitted in the pool area. In case of an emergency, call 911 and notify Arka Motel staff. By using the pool, guests acknowledge and accept that swimming and pool activities involve inherent risks. Guests assume full responsibility for their own safety, as well as the safety of any minors or dependents in their care. Use of the pool outside of designated hours is strictly prohibited.
• Health and Safety: Guests with any health conditions (e.g., heart conditions, epilepsy) that may be exacerbated by swimming or heat exposure are advised to consult with a medical professional before using the pool. Arka Motel is not responsible for any health issues or injuries that may occur.
• Waiver of Liability: By using the swimming pool, guests acknowledge that they are aware of the risks associated with swimming and agree to assume full responsibility for their own safety and that of their children or any other dependents under their care. Arka Motel shall not be liable for any injuries, accidents, or deaths that occur in or around the pool area.
• Parental Responsibility: Parents or guardians are fully responsible for the safety and behavior of their children in the pool area. Arka Motel assumes no responsibility for children who are unsupervised or not adequately supervised by an adult.
• Reporting of Hazards: Guests are encouraged to report any unsafe conditions, broken equipment, or other hazards in the pool area to Arka Motel staff immediately. Arka Motel will take reasonable measures to address any reported issues promptly.
• POOL HOURS: The pool is open from 10:00 AM to 10:00 PM, April through September.
• BIKING TRAIL SAFETY AND WAIVER OF LIABILITY: The trails at Arka Motel are reserved exclusively for registered guests. For safety, helmets are required at all times while riding, and guests must stay on marked trails. Trail use is at the guest’s own risk, and Arka Motel is not liable for any injuries, accidents, deaths, or property damage related to trail use. Minors under 18 must be accompanied by an adult. Guests should practice proper trail etiquette by announcing when passing others and respecting fellow riders. Caution is advised as the trails may feature steep descents, sharp turns, and wildlife. In case of an emergency, call 911 and notify Arka Motel staff. By using the trails, guests accept full responsibility for their safety and the safety of their dependents. Trail hours are from 8:00 AM until sunset.
• Health and Safety: Guests with any health conditions (e.g., heart conditions, epilepsy) that may be exacerbated by swimming or heat exposure are advised to consult with a medical professional before using the pool. Arka Motel is not responsible for any health issues or injuries that may occur.
• Waiver of Liability: By using the swimming pool, guests acknowledge that they are aware of the risks associated with swimming and agree to assume full responsibility for their own safety and that of their children or any other dependents under their care. Arka Motel shall not be liable for any injuries, accidents, or deaths that occur in or around the pool area.

• FIRE PIT SAFETY AND WAIVER OF LIABILITY: The fire pits at Arka Motel are for the exclusive use of registered guests. Fires must be attended at all times and never left unattended. The use of the fire pits is at the guest’s own risk, and Arka Motel is not responsible for any injuries or property damage that may occur. Arka Motel is not liable for any injuries, accidents, deaths, or property damage related to fire pit use. Guests must ensure that fires are completely extinguished before leaving the area. Minors under 18 must be supervised by an adult. Horseplay and throwing objects into the fire are prohibited, as is the use of flammable liquids to start or maintain the fire. Guests must maintain a safe distance from the fire pit and keep all furniture and belongings away from the fire. Fire pit hours are from 10:00 AM to 10:00 PM daily.
• HEALTHY AND SAFETY: Arka Motel is committed to ensuring the health and safety of its guests. However, guests are advised to take care when using facilities such as swimming pools, fire pits, or any other recreational areas. Arka Motel is not liable for any accidents, injuries, or health issues that may occur during the use of these facilities.
• NATURAL DISASTERS and UNFORESEEN EVENTS: Arka Motel is not responsible for any loss, damage, or inconvenience caused by natural disasters, acts of God, or other events beyond its control (e.g., power outages, severe weather, or government actions). In such cases, Arka Motel will make reasonable efforts to assist guests but cannot guarantee refunds or compensation.
• THIRD-PARTY SERVICES: Arka Motel may recommend or arrange services provided by third parties (e.g., tours, transportation). These services are offered independently of Arka Motel, and Arka Motel is not liable for any issues arising from the use of such third-party services.
• LIMITATION OF LIABILITY: To the maximum extent permitted by law, Arka Motel's total liability for any claim arising out of or in connection with a guest's stay shall not exceed the amount paid by the guest for their stay. Arka Motel is not liable for any indirect, incidental, or consequential damages.
• PET POLICY: Dogs only with a maximum of 2 dogs per room. Guests MUST book a pet-friendly room, pick up after their pets, and minimize barking. There is a pet fee of $50 per dog per reservation. Unauthorized pets in non-pet-friendly rooms may result in a $150 fee and reservation cancellation. Pets are not allowed in shared spaces such as the lobby, fire pit area or pool. Owner is responsible for any damage caused by pets. Extra cleaning fees may apply if rooms are excessively dirty from pets.
• REGISTERED GUESTS: Accommodations will only be provided to guests registered with Arka Motel, with a maximum occupancy of 2 persons for King rooms and 4 persons for Double rooms; unauthorized overnight guests will result in a charge of $250 per night to the registered guest.
• QUIET HOURS: To ensure a restful environment for all guests, quiet hours are maintained from 10 PM to 8 AM.
• PARKING: Parking spaces are limited and are on a first-come, first-served basis. Arka Motel is not responsible for any loss or damage to vehicles or personal belongings left in vehicles.
• SECURITY: Safety cameras are used throughout the premises, and anyone on our property may be recorded.
• PRIVACY: Personal information collected during booking and stay will be used for reservation management, billing, and marketing purposes as per our privacy policy.
• Arka Motel, its owners, members, stockholders or employees are not responsible for lost or stolen objects or any personal injury or death.
• INDEMNITY: Guests agree to indemnify and hold harmless Arka Motel, its owners, employees, and agents from any liability, loss, damage, or expense (including legal fees) incurred by Arka Motel as a result of any claims, actions, or demands arising out of or relating to the guest's stay. This includes, but is not limited to, claims for personal injury, damage to property, and disturbance caused to other guests.
• AMENDMENTS: Arka Motel reserves the right to amend these terms and conditions at any time without prior notice

By booking a room and staying at Arka Motel, you acknowledge that you have read, understood, and agree to be bound by these terms and conditions.
